Encore Capital Group, a San Diego based debt portfolio buyer and its subsidiaries Midland Funding LLC and Midland Credit Management Inc., are being sued by the Minnesota AG for alleged robo signing of court affidavits.
According to Minnesota Attorney General Lori Swanson, “Midland has perverted the justice system by filing robo-signed affidavits in court and hounding citizens for debt they don’t owe.”
The lawsuit, filed in Hennepin County, Minnesota, reportedly includes testimony from Midland employees that some had signed as many as 400 affidavits a day without reading through them.
Minnesota’s action follows an Ohio Judge’s ruling that cleared the way for the lawsuit to proceed. The Judge ruled that Minnesota’s cases would not interfere with a previously filed $5.2 million class action against these giants of the debt collection agency industry. The lawsuit ask for a cessation to improper practices and fines of $25,000 per violation and for contempt of court. <

This post is especially for you shopaholics out there who feel guilty about putting so many unneeded purchases on your credit cards – and I’m not just talking to women. Men, you know you’ve purchased the latest gizmo or the best seats at the game when cash wasn’t necessarily available.
I want to make sure you know about the upcoming shopping season. Memorial Day sales are coming. Those new shoes, that to-die-for bathing suit, the new sofa you need for the living room, and that flat screen TV – they’ll all be on sale. Shortly after that, we’ll have Fourth of July sales, then back to school shopping. Computers will be a good deal then. Now that Discover has ended its no fee balance transfer promotion, you may be wondering if there are any other alternatives out there.
In short, the answer is an unfortunate “no.”
That’s right; no other credit card issuers are brave enough to offer a no fee balance transfer credit card at the moment, perhaps still spooked from the credit crisis that appears to be nearing its end.
Even pre-credit crisis, I don’t think Chase offered a no fee balance transfer; only Citi seemed to take that plunge.
